Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tunibee, available at https://www.tunibee.com, operated by TheYungClub (SIRET: 90427034500013), a company based in France ("Tunibee," "we," "us," or "our").
By accessing our website, placing an order, or using our services, you agree to these Terms. If you do not agree, please do not use Tunibee.
1. What Tunibee Does
Tunibee creates personalized AI-generated digital songs and giftable music experiences.
Customers provide creative information, text, preferences, and optional images. Tunibee uses this information, together with artificial intelligence tools and creative production processes, to generate a custom digital song and make it available through a digital player, which may include karaoke-style features and other presentation features.
Tunibee does not currently provide user accounts or subscriptions. Products are sold as one-time digital purchases.
2. Eligibility
You must be legally able to enter into a binding agreement to use Tunibee.
Tunibee is not directed to children under 13. If you are under the age of majority in your country, you may use Tunibee only with the permission and involvement of a parent or legal guardian.
By using Tunibee, you represent that you have the legal right and authority to agree to these Terms.
3. Orders and Customer Information
To place an order, you may be asked to provide information such as your name, email address, creative details, text, images, preferences, and other information needed to create your personalized song.
You agree that:
- The information you provide is accurate and complete;
- You have the right to provide all text, images, names, stories, and other materials submitted to Tunibee;
- Your submitted content does not violate the rights of any third party;
- Your submitted content does not contain illegal, harmful, abusive, or prohibited material.
We are not responsible for delays, errors, or unsatisfactory results caused by inaccurate, incomplete, unclear, or unlawful information submitted by you.
4. AI-Generated and Personalized Content
Tunibee uses AI systems and creative tools to generate lyrics, music, and related digital content.
You understand and agree that:
- AI-generated content may vary in style, tone, quality, structure, lyrics, melody, voice, and musical interpretation;
- Results are creative and subjective;
- We do not guarantee that the song will meet every personal expectation or preference;
- We do not guarantee that AI-generated content will be completely unique, error-free, or free from similarities to other AI-generated or human-created content;
- We may refuse, edit, or adapt prompts or content that violate these Terms, create legal risk, or are technically unsuitable.
Tunibee will make reasonable efforts to provide a personalized digital product based on the information you submit.
5. Payments
Tunibee sells one-time digital products.
Payments are processed by Stripe or another payment provider made available at checkout. By submitting payment information, you authorize the payment provider to charge the applicable amount, including any taxes, fees, or charges shown at checkout.
We do not store your full credit card information on our own systems.
Prices may change at any time without prior notice. Price changes do not affect orders that have already been paid for.
6. Taxes
Applicable taxes, including VAT, sales tax, or similar charges, may be calculated and collected through Stripe or another payment provider.
You are responsible for any taxes, duties, or charges applicable to your purchase, except for taxes based on our income.
7. Delivery
Tunibee products are delivered digitally.
After your order is processed, we will make the personalized song or digital gift experience available through the method shown on our website or communicated to you by email.
Delivery times, if displayed, are estimates only. We are not responsible for delays caused by payment issues, incomplete information, technical issues, third-party providers, or events outside our reasonable control.
8. Refunds and Cancellations
Tunibee creates personalized digital products based on the information you provide.
Because each order is customized and digital, all sales are generally final once production has started or once the product has been delivered, to the fullest extent permitted by applicable law.
However, if there is a technical issue, delivery issue, or significant problem with your order, please contact us at help@tunibee.com.
Our support team may, at its discretion, offer a correction, replacement, credit, partial refund, full refund, or another appropriate solution depending on the situation.
Nothing in these Terms limits any mandatory consumer rights that may apply to you under applicable law.
If you are located in a jurisdiction that grants a statutory withdrawal or cancellation right for digital content, you acknowledge that by placing an order you request that we begin creating your personalized digital content before any withdrawal period expires. To the extent permitted by law, you may lose the right to withdraw once performance has begun or once the digital content has been delivered.
9. Acceptable Use
You agree not to use Tunibee to submit, create, request, upload, generate, or share content that:
- Is illegal, fraudulent, deceptive, or harmful;
- Infringes copyright, trademark, privacy, publicity, or other rights;
- Contains threats, harassment, hate, abuse, or targeted attacks;
- Contains grossly offensive, obscene, or abusive language;
- Exploits or harms minors;
- Includes sensitive personal information without proper authorization;
- Attempts to impersonate another person;
- Promotes self-harm, violence, or illegal activity;
- Attempts to bypass safety, security, moderation, or technical limitations;
- Abuses, overloads, manipulates, scrapes, reverse engineers, or disrupts Tunibee;
- Uses automated systems, bots, scripts, or scraping tools without our permission.
We may refuse to process, cancel, remove, disable, or restrict access to any order, content, link, or digital player that violates these Terms or creates legal, safety, operational, or reputational risk.
10. User Content
"User Content" means any text, images, prompts, names, stories, memories, instructions, preferences, or other materials you provide to Tunibee.
You retain ownership of your User Content.
By submitting User Content to Tunibee, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, process, adapt, host, transmit, display, and share the User Content solely as reasonably necessary to:
- Provide the service;
- Create your personalized song;
- Generate lyrics, music, and related digital content;
- Operate the digital player and gift experience;
- Provide customer support;
- Maintain security and enforce these Terms;
- Comply with legal obligations.
You represent and warrant that you have all rights necessary to grant this license.
11. Ownership of Tunibee Content and Generated Songs
Tunibee, TheYungClub, and our licensors own all rights, title, and interest in and to the Tunibee website, software, designs, branding, logos, systems, workflows, technology, templates, and other materials used to operate the service.
Unless otherwise stated in writing, Tunibee owns or controls the rights in the final personalized song, AI-generated outputs, digital player, and related creative assets created through the service.
After full payment, Tunibee grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access, listen to, share privately, and gift the personalized digital song and related digital player for personal, non-commercial use.
You may not, without our prior written permission:
- Resell the song;
- Upload it to commercial streaming platforms;
- Use it in paid advertising;
- Claim authorship or ownership of the underlying music production;
- Register it with copyright offices, collection societies, or music rights organizations;
- Use it for commercial purposes;
- Modify, redistribute, sublicense, or exploit it beyond personal gift use.
If you want broader commercial rights, you must contact us first.
12. Third-Party Services
Tunibee may rely on third-party services, including payment processors, hosting providers, email tools, AI providers, and music generation tools.
We are not responsible for third-party services, platforms, policies, outages, errors, or processing delays. Your use of third-party services may be subject to their own terms and privacy policies.
13. No Accounts
Tunibee does not currently require users to create accounts.
Even without accounts, we may still restrict, refuse, cancel, or block orders, email addresses, payment methods, links, or access where we believe there has been misuse, abuse, fraud, illegal activity, or a violation of these Terms.
14. Availability and Changes to the Service
We do not guarantee that Tunibee will always be available, uninterrupted, secure, or error-free.
We may modify, suspend, discontinue, or limit any part of the service at any time, including features, pricing, product options, delivery methods, AI providers, and the digital player experience.
We may also update or remove content, links, or digital players where necessary for technical, security, legal, or operational reasons.
15. No Professional Advice
Tunibee is a creative entertainment and gifting service.
The service must not be used for medical, legal, financial, safety-critical, emergency, or other high-risk decisions. Any content generated through Tunibee is for personal and entertainment purposes only.
16. Disclaimer of Warranties
Tunibee is provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and error-free operation.
We do not guarantee any specific artistic, emotional, musical, commercial, or personal result from the use of Tunibee.
Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable consumer protection laws.
17. Limitation of Liability
To the fullest extent permitted by applicable law, Tunibee and TheYungClub will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, emotional distress, business interruption, or reputational harm.
We are not liable for issues caused by:
- Incorrect or incomplete information provided by you;
- Third-party service failures;
- Payment provider issues;
- AI provider limitations or errors;
- Internet, hosting, or technical outages;
- Unauthorized use of your order link or digital player;
- Your misuse of the service;
- Content submitted by you.
Nothing in these Terms limits liability where such limitation is prohibited by law.
18. Indemnity
To the fullest extent permitted by law, you agree to indemnify and hold harmless Tunibee, TheYungClub, and our team from any claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of Tunibee;
- Your User Content;
- Your violation of these Terms;
- Your violation of any law or third-party right;
- Your misuse of the personalized song, digital player, or generated content.
19. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using Tunibee, you acknowledge that we may process your information as described in the Privacy Policy.
20. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we may post the updated Terms on our website, update the effective date, or provide notice by other appropriate means.
Your continued use of Tunibee after updated Terms are posted means you accept the updated Terms.
21. Governing Law and Jurisdiction
These Terms are governed by the laws of France, without regard to conflict of law rules.
Subject to any mandatory consumer protection rights that may apply in your country of residence, disputes relating to these Terms or Tunibee will be submitted to the competent courts of France.
Nothing in these Terms limits any mandatory rights you may have as a consumer under applicable law.
